Please thoroughly read these Terms and Conditions. These Terms and Conditions apply to your access and use of this Site. You are using this Site at your own risk and agree that these Terms and Conditions and any further instructions, limitations or rules as they may be posted on the Site on specific parts or services will apply. All other guidelines, restrictions or rules that are posted are hereby incorporated by reference to these Terms and Conditions.
Pack Heap™ may at any time without notice modify this Site and these Terms and Conditions. The Terms of Use should be read on each occasion of use of this Site.
COPYRIGHTS AND TRADEMARKS
Any other images, graphics, text or other content that you add to your Products is used in conjunction with Content and is the sole responsibility of you. You are responsible for not including any text, image, design, trademark, service mark or copyrighted work of any third party in your Products without the proper authorizations from the owner of that text, image, design, trademark or service mark. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party and that you have all required rights or permissions necessary to incorporate third party material into your Products. In placing an order on this Site you warrant that you have all necessary permission, right and authority to place the order and you authorize packheap.com™ to produce the Products on your behalf.
CUSTOMER CONTENT
You are the sole user of Content when you combine Content with other images, graphics, text or other material included in your Products. You agree that you will not incorporate any text, image, design, trademark, service mark or any copyrighted work of any third party in your Products without securing the necessary authorizations from any third party copyright owner. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party and that you have all required rights or permissions necessary to incorporate third party material into your Products. Placing an order on this Site is a confirmation by you that you have all the necessary permission, right and authority to place the order and that you authorize packheap.com™ to create the Products on your behalf.
All the information, data, text, photographs, graphics, messages and other material (Content) are the responsibility of the individual who produced the Content. Therefore, you have ultimate responsibility for any Content that you send, upload, post or otherwise send or upload to the website. You agree to follow all local rules and regulations concerning online behaviour and acceptable content. You are not responsible for anything that you upload, post or otherwise send over the Website that contains indecent, illegal or infringed content on the website, and packheap.com™ does not control the content of the Website or guarantee its accuracy, integrity, quality and completeness. Under no circumstances will packheap.com™ be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable.
You are responsible to protect your password and to restrict access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account. By sending a print order using your password, you grant the worldwide, royalty free, non-exclusive license to use, reproduce, sublicense, modify, adapt, publish, display and create derivative works of the Content found on the website and on the printed product for the purpose of storing a design or for processing a print order sent to packheap.com™.
You acknowledge that packheap.com™ and its designees shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. packheap.com™ may preserve Content and may also disclose Content if required to do so by law or in the case that such disclosure is necessary to (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of packheap.com™, its users and the public.
DESIGN FILES
Designs will only be available from packheap.com™ at 72 DPI (low resolution). If you would like to purchase higher resolution designed files, please contact Sales@packheap.com for a quote.
CUSTOMER SUBMITTED ARTWORK
packheap.com™ will not be held liable for any changes in color mode from RGB to CMYK or for images being generated as fuzzy, distorted or pixilated because they were provided by the customer.
PROOFING & MATCHING
Customer approval of final artwork and job specification sheet is a requirement for all print jobs. After order, artwork proofs and a job specification sheet will be sent to the customers by e-mail. The customer is responsible for checking all of the details in the specification sheet (including the delivery dates and/or production speed) and confirm that all of the requirements are correctly recorded. packheap.com™ is not responsible for any specification or requirements not mentioned in the specification sheet. Further, it is the customer’s responsibility to check the artwork once it is completed as proofreading is the customer’s responsibility. Because files can be prepared in a number of ways, there is a possibility for unplanned change. Packheap.com™ strongly recommends the proof to be printed at 100% to verify the actual position, spelling and other design elements, Packheap.com™ will not accept any design and spelling error that has not been identified from the proof and communicated to packheap.com in a timely manner. Once the design is approved, the design file and the job specifications will be sent to the production department and be printed according to the specifications.
packheap.com™ is not responsible for color matching or ink density of screen proofs approved by the customers. packheap.com ™ will attempt to match the gradient density of each of the colors in a duo-tone, but color and density will not be guaranteed, except when a customer requests a color match proof. Further, lamination can alter or impact the final colour appearance of printed colours. packheap.com™ cannot be held responsible for the final colour appearance of laminated products.
MATERIALS
Please note that the paper/card stock used for printing our products have different level of food grade nature. any such requirement should be communicated in writing immediately. Please indicate any particular food grade needs prior to ordering this item.
THE CUSTOMER IS RESPONSIBLE FOR PROOF AND LAYOUT APPROVAL PRIOR TO THE PRINTING.
packheap.com™ is NOT LIABLE for errors in a printed product from any of the following:
You have used the wrong font for a graph or on it.You have used either the wrong font, or the wrong Graphics Orientation for a graph.
Satisfactory spelling, grammar and punctuation, Year 1.Year 1, spelling, grammar and punctuation satisfactory.
Wrong Die cuts or Incorrect and Missing Folds or Slits

COLOR ACCURACY AND HARDCOPY PROOFS
packheap.com™ will do its best to reproduce colors from print ready files received. However, packheap.com is unable to guarantee colour match and colour density due to restrictions imposed by the printing processes, different properties of various printing surfaces and the neighbouring image ink requirements. Color reproductions will be within 90% of the actual color upon final proof that you approved. Please note: Packheap.com will only guarantee your file colour for printing if you order a paper proof at an extra cost. Note: packheap.com does not guarantee that colors will be the same between what is submitted as print ready and the actual artwork or product.
INDEMNITY
You agree to defend, hold harmless and indemnify packheap.com™ and each of the other parties from whom packheap.com™ has acquired portions of Content, and their directors, officers and employees, against all claims, liability, damages, costs or expenses arising out of or relating to (i) your breach of any provision of these Terms and Conditions or (ii) any suit, claim or demand against packheap.com™, the other parties or any of their directors, officers or employees for any text, photograph, image, graphic or other material you incorporated into Products not included in the standard Site Content.
ORDER SHIPPING AND DELIVERY
When ordering from packheap.com™, you have the following production options:

There is no guarantee for shipments under Standard Service.
PRIORITY – guaranteed delivery in 6 business days:
Free Ground shipping is included within 48 contiguous states.
Products are available for shipping 6 business days after final proof approval.
The Guaranteed Delivery of the Express item is 6 business days.
FREE ground shipping in 48 contiguous states.
After final proof products will be shipped within 6 business days.
No matter which, proof of final print must be received no later than 11:00 AM EST or additional 1 business day will be added to shipping times!
At all times packheap.com™ will strive to ensure that orders are printed and shipped promptly. Packheap.com™ will not be liable in any way to the buyer for any delay in the production, shipping or delivery of ordered products.
Our shipment and delivery dates are based on estimates from our suppliers and from our recent order history; packheap.com™ will not be liable for any delays in shipment that may result from technical issues, weather conditions, shipping company delays, international customs issues or any other circumstances beyond packheap.com™’s direct control.
packheap.com™ will do everything it can to ensure delivery schedules are met. However, unexpected equipment failure, malfunction or technical problems may cause delays in the printing or shipping process. Rush fees/expedite fees will be refunded or waived as appropriate, if printing or shipping is delayed. Orders will not be cancelled as a result of delay in printing or shipping.
All packheap.com™ customers agree to pay all customs duties and fees on goods shipped to them at their respective locations. It is the responsibility of the customers to make arrangements to clear customs for shipments delivered outside the United States.

Customer must check for all packages for signs of damage or missing items before they are delivered (compared to goods specified on the enclosed package packing slip and/or invoice). The customers will be liable to cover any 3rd party shipping errors, omissions or damaged shipments and packheap.com™ will not be responsible for such errors unless the claim is made to packheap.com™ within 3 Business Days of delivery of the order.
When ordering each product you will typically receive a couple extras, free of charge. An exceptionally small number may be shipped as a result of a small order. Printing trade standards allow for underages or overages of up to 5%. In case of requirement of any exact quantity, it is recommended to customers to order 10% more than the exact quantity.
If the customer enters an incorrect shipping address, an additional shipping/handling charge will be added to the package if it must be re-shipped.
DISCLAIMER OF WARRANTY
The site and content is given on an “as is” basis with no warranty of any kind, express or implied, including warranties of merchantability, fitness for a specific purpose or of non-infringement. You accept that the operation of the site may not be continuous or without error. The site may contain links to and references to products or services of independent companies. All references and links are made on an “as is” basis, without any guarantees, guarantees of warrantability, or guarantees of fitness for a particular purpose.
LIMITATION OF LIABILITY
Packheap.com and its licensors, suppliers or vendors, their officers, directors, employees or agents are in no way liable for any special, incidental, indirect or consequential damages of any kind, or for any damages whatsoever arising from any loss of use, data or profits, whether or not packheap.com is informed of the possibility of such loss. Packheap.com will not be responsible or liable in any way for any damages or consequences of your misuse or unauthorized use of this site or its content.
